Journalists express dismay at govt expansion of media censorship

Committee to Protect Journalists (CPJ) states in a press release the latest moves by the Sri Lankan Government for the expansion of censorship regulations governing media coverage of the on going civil war are in "flagrant violation" of its pledge made upon coming to power of strengthening constitutional guarantee for a free press.

The full text of CPJ's press release is as follows.

The Committee to Protect Journalists (CPJ) is writing to express deep dismay over your government's expansion of censorship regulations governing media coverage of the civil war between the government of Sri Lanka and the Liberation Tigers of Tamil Eelam (LTTE).

On August 17, the Defence Ministry imposed an immediate ban on publishing any news regarding the transfer of officers within the government security forces high command. The ministry maintained that such information could be used by the LTTE in devising their own military strategy.

When Defence Secretary Chandrananda de Silva announced, on June 5, that you were introducing regulations "Prohibiting the publication and transmission of sensitive military information," CPJ joined the press in Sri Lanka in condemning this anti-democratic move. We noted, in a letter sent on June 9, that the regulations are exceptionally harsh, and all the more troubling for the military's direct role in deciding what is censored. We are alarmed that instead of responding to these concerns, you have decided to further restrict an already muzzled press.

As a nonpartisan organization dedicated to the defence of our colleagues worldwide, the Committee to Protect Journalists respectfully calls on your Excellency to honour the commitments your government made upon coming to power in 1994, promising to strengthen constitutional guarantees for a free press. The Free Media Movement of Sri Lanka has noted that these latest moves by the administration are in "flagrant violation" of that pledge.

CPJ believes that the present conflict in Sri Lanka can only be resolved through an open exchange of information and ideas, and so once again urges you to lift the restrictions you have placed on both the foreign and local news media.

PA rethinks Presidential Elections

With the postponement of the Provincial Councils election, the question that is being now asked in political circles is whether the government would go ahead with a Presidential election by February next year. The PC elections were postponed indefinitely this month using emergency regulations which were clamped islandwide through a Presidential proclamation. Government's constitutional expert, Minister Prof. G. L. Peiris made it known to the Mahanayakas of the Asgiriya and the Malwatte Chapters that the PC elections were postponed to put the country first before elections as armed forces men if pulled out for election duty would result in hindering the ongoing war against the LTTE. Prof. Peiris went a step ahead to tell the people that the government was much more keen to go for a Presidential election to take up the challenge thrown by the UNP and Opposition Leader Ranil Wickremesinghe.

Mr. Wickremesinghe who got wind of the government's move to postpone PC elections threw that challenge and urged that a Presidential election should be held by November this year. The PA government which gave security problems as the obstacle for going for such an election made it known that it would face a Presidential poll in February next year. There was speculation that the government was going to hold it in January next year. Reliable sources last week disclosed that the government was likely to drop this idea and President Chandrika Kumaratunga would run the full term of office, a six year period due to end in November 2000.

Top level PA sources revealed that President Kumaratunga who is reported to have made an evaluation of the performances of her government was unhappy on the achievements made so far. They said that a major part of the promises made to the people in her election manifesto was yet to realise. The UNP last Monday decided to kick off the protest campaign against the postponement of elections from Tuesday in Parliament.

When the House sat on Tuesday morning UNP MPs carried placards screamed and protested in the House forcing the Deputy Speaker Anil Moonesinghe to bring the sessions to an abrupt end. However, many opposition and senior government parliamentarians were unhappy over the stance taken by the UNP that morning as the business of the day was messages of condolences on late Members of the House. They felt that the UNP should have staged that protest on some other day in the House as Members of Parliament by tradition are bound to maintain a solemn attitude when motives of condolences are moved.

UNP backbenchers were annoyed that their partymen were attacked on the eve of the Hyde Park meeting the Friday before when the party organised a peaceful meeting to protest against the postponement of the PC elections. 'Therefore, we thought that we must start our protest from the highest place and that is the Parliament' said a UNP backbencher.

The People's Alliance government of late have been silent on the issue of holding a Presidential election early next year. Instead it has once again refocussed to the controversial devolution package. Architect of the package Minister Peiris, the new SLFP Chief Organiser for Colombo East was busy last week back again to muster the support of the opposition parties for his package. The coalition partner in the government, the LSSP first came out to support the package after months at the Lipton Circus day before yesterday. The theme of the protest was to ask the people to force the UNP to accept the devolution package for implementation early next year. This protest campaign of the LSSP was given wide publicity in the state electronic media both before and after the event. It is learnt that the Communist Party which is also an alliance partner in the PA will conduct a similar protest early next week under the same theme.

The UNP is yet to submit its final set of alternate proposals to the package. Early this year the government warned that if the UNP did not submit its set of proposals before the end of last February it would decide to get the people's consent to the package through a referendum. The UNP paid scant respect to the PA threat and continued to ask for time. Finally the PA threat appeared to have died a natural death with the package still in the brief case of the government. Tamil political parties last week hinted that it was not only the previous government but also the government of the day was playing with the ethnic problem by delaying the process to resolve it.

The Kumaratunga government completed four years in office last Wednesday. It had been accused of giving false promises to the people. The latest attack is to emerge from none other than the pensioners who are apolitical. They have decided to hold a meeting in Colombo next week to pressure the government on the pledges given to pensioners. The meeting will remind the government of these pledges in the manifesto (a) The arrears due from the Rs. 260 pension allowance will be paid immediately. (b) Special consideration will be given to the children of pensioners when vacancies in their former work places are filled. (c) An extra allowance will be added to the pensions of those who have children attending school. (d) Anomalies with regard to pensions will be rectified and an uniform and equitable structure introduced. Action will be taken to make pensions index linked. Concessionary fares will be available for senior citizens in respect of public transport. The pensioners claim that these recommendations were made by the PA and they voted for the PA with much expectations to get them. 'Four years have gone and we are still at square one', lamented a senior pensioner of the Pensioners' Association.


Nayaka Thera rendered yeoman service to the nation

The cremation of the Bambalapitiya Vajira-ramadhikari and the Sangha Nayake of the Amarapura Maha Sangha Sabha the Ven. Piyadassi Nayaka Thera took place at the Henry Pedris Esplanade yesterday before a large and representative gathering.

Earlier in the day the remains of the prelate were carried in a Ransivige from Vajira-rama Vihara to the cremation grounds.

The casket con-taining the remains were received by the Colombo Mayor Karu Jayasuriya, Minister of Buddha Sasana, Cul-tural and Religious Affairs Laxshman Jayakody, Army Com-mander Lt. General Rohan Daluwatta, members of the foreign diplomatic corps and others and carried to the special pyre. Ven. Pundit Ahungalle Wimalanandatissa Nayaka Thera adminis-tered Pansil and Pundit Weligama Gnanaratana the chief incumbent of Mallikaramaya Ratma-lana performed the Mataka Wasthra Pooja.

In a special message by President Chandrika Kumaratunga which was read by Minister Lakshman Jayakody he had said the "Ven. Piyadassi Nayaka Thera had rendered a tre-mendous service to the nation, religion and the Sinhalese race. A great honour was brought to the country by his writing. She considered it a great privilege for her to come to know this great scholar monk from her childhood".

Minister Jayakody said considering the great service rendered by the late prelate, the void created by his demise was hard to fill. He preached to suit the modern age. Piyadassi Nayaka Thera could be described as one of the greatest members of the Maha Sangha of this century, the Minister said.

Among others who spoke were the most Ven. Madihe Panna-seeha the chief Sangha Nayaka of Amarapura Sect., the Ven. Pundit Madhathiyawela Piyadassi Anunayake Thera, the Ven. Madalu-wawe Sobhitha Nayake Thera of the Naga Vihara of Kotte and President of the Sangha Sabha, Ven. Darana-gama Kusala Dhamma Thera and V. J. M. Lokubanda MP, chief Opposition Whip.

The pyre was lit by S. Karunaratna and Asoka Mallawarachchi.


Ranil's security head also sent on compulsory leave

The Officer-in-Charge of the Opposition Leader Ranil Wickremesinghe's Security Division IP Sudath Chandrasekara has been sent on compulsory leave UNP sources told 'The Island' yesterday.

According to authoritative sources the order has come from a Defence Ministry top official.


Another transformer destroyed

BATTICALOA: Tigers have blasted a 2000 kv transformer in Sammanthurai on Thursday (20) night. The attack had occurred around 10.45 pm. One home guard and three civilians had been injured in the attack.

The blast had also resulted in over 4000 houses losing their electricity supply.

The damage has been estimated at Rs.20 lakhs.


Rights application filed on behalf of student

A fundamental Rights application has been filed on behalf of an year eleven student of Southland Balika Maha Vidyalaya of Galle, alleging that the principal of the school had denied her the opportunity to sit the G.C.E. Ordinary Level examination in December 1998, as an internal candidate of this school.

The petitioner is Koonage Shirmila Chandrasekera of Kaluwella, Galle. The petition said that the mother of Shirmila is a teacher of the same school, and that the teacher was suspected of having petitioned against the principal.

In July this year, the principal had entertained admission applications from other year eleven students of the school, to enable them to sit the examination. But Shirmila's had not been entertained by the principal, who had used unkind words on her on certain occasions.

The parents had spoken to the principal, and the relevant educational authorities, to enable the girl to sit the exam. But there had been no positive response.

The petition alleged unequal treatment, and requested the Court to grant leave to proceed, declare the violation of Fundamental Rights of Shirmila and further to direct the Principal, Neli Kumarasinghe and the Commissioner of Examinations, to admit the said student to sit the Ordinary Level, G.C.E. examination as an internal candidate of the school, in December this year.

The petition has been filed by Attorney-at-Law Upula Gamini Kalugalwinna on behalf of the minor student.

The respondents are the Principal, Neli Kumarasinghe, The Commissioner of Examinations, and the Attorney General.


Presidential Task Force recommended for elephant conservation

Representatives from the Bio Diversity and Elephant Conservation Trust, will be making representations to President Chandrika Kumaratunga, next week, to urge the setting up of a Presidential Task Force for Elephant Conservation, member of the Trust, Jayantha Jayawardena told ÔThe Island' yesterday.

The Task Force, he said could place before the President recommendations for the effective management and conservation of elephants at this meeting according to him.

Mr. Jayawardena added that the setting up of a Task Force for Elephant Conservation would 'help formulate official policies for elephant conservation and assist in the implementation of all elephant conservation plans. We hope NGO's and the Department of Wild Life Conservation will find it possible to collaborate in the activities of the Task Force for Elephant Conservation,' he added. The Task Force could bring together the various departmentrs and government Ministries with an impact on subjects such as environment, agriculture, forests, irrigation, wild life conservation etc.

The main thrust of the Task Force according to Jayawardena will be the protection of crucial areas within an elephant range, the improvement of the quality of habitat and the accommodation of the socio-economic needs of the people who share the habitat with elephants.

The recommendations of the Trust compiled following the country's first Symposium on the elephant, organized by the Bio Diversity and Elephant Conservation Trust, at the BMICH in July of this year are as follows:

* management of key elephant popu-lations,

* amelioration of human elephant conflict,

* managed elephant ranges,

* impact of elephant in Sri Lanka's bio diversity,

* community participation in elephant conservation,

* development of the elephant orphanage at Pinnawela,

* management of elephants in captivity,

* improving the department of wild life conservation,

* welfare of the guard force,

* conservation education and public awareness.

The Trust further recommends the main-tenance of populations of about 500 effective breeding individuals to remain viable from an evolutionary point. 'Since most of Sri Lankan elephant populations are small and isolated, the goal should be to maintain an effective population size of at least 50 breeding individuals to counter inbreeding in the short term. This would translate into a total population of about 125-150 animals, assuming an adult male-female sex ratio of 1:2. Such units could then be clustered and managed as metapopu-lations to ensure the long term survival of the species,' it is further added.


Crackdown on Jaywalkers

Colombo City Traffic Police will impose an on the spot fine of rupees 250/= on all pedestrians who jaywalk across Colombo roads from today, said SP Colombo City Traffic Police D. M. C. A. Mendis.

This new law to spot-fine jaywalkers was gazetted yesterday.

From morning today, all City Traffic or other divisional traffic personnel would make it a point to direct all pedestrians to make use of the Zebra Crossings to cross the streets of Colombo and refrain from jaywalking.

The City Traffic Police will be tough on those drivers who violate the traffic laws while driving holding on to the steering wheel with one hand while using the other to hang on to a Cellular phone police said.

"We would produce these people in courts where they would be fined a minimum of ruppes 750/= and have their cellular phones kept at the respective police ttations until the court cases are disposed of said the spokesman. (F.R.S.)


Police grill suspect arrested

Kandy: A Grama Niladhari residing close to the house at Pahala Aludeniya in Daulagala where a large stock explosives were found concealed is currently being extensively grilled in connection with the detection.

A LTTE suspect committed suicide by taking cyanide while the other made an attempt on his life also by taking lethal poison after the explosives were detected.

He is now in police custody and being interrogated by a special team of police investigators.

Police said it has been disclosed now that the Grama Niladhari and his wife who too is a Grama Niladhari, have maintained links with the LTTErs and the Burgher woman who has rented out a part of her house to the LTTE.

The Grama Nila-dhari police said, had tried to make out that the LTTEers were his cousins. He had even helped them to get driving licences.

Police are now looking for a broker who had helped the LTTErs to purchase a vehicle from Chilaw area.

Police have recovered in a search of the house of the Burgher woman some more explosives, and equipment including a bouth and a metal cutter, sources added.

Investigations are conducted by a special team of police officers under the supervision of the DIG, Central, Sirisena Herath and Kandy SSP, Nimal Mediwake.


Rifai Manaqib flag hoisting ceremony

The yearly flag hoisting ceremony of His Holiness Saint Sulthanul Arifeen Seyyidna Ahamed-ul-Kabeerur Refai will be held on Sunday August 23 at 5.30 p.m. at Muhiyiddeen Thakkiya 1st Mosque Lane, Colombo 12.

On this occassion His Holinesu Rifai Moulana Al Haj U. P. Seyyid Asik Thangal will preside. Following this Rifai Mowlood will be recited for 11 days after Mahrib prayers. The final Thamam will take place on September 13 at 10 a.m.

The Rifai Thareeq Association of Sri Lanka was founded in 1878 by His Eminence Seyyid Muhammed Yoosuf Rifai Thangal, Grandfather of His Eminence Rifai Moulana Al. Haj P. P. Seyyid Nallakoya Thangal. Commemoration ceremony of Al Haj Seyyid Pathhudeen and Sulthanul Arifeen Seyyidina Ahamed-ul- Nabeerur Rifai will take place. At this function Kaleefathur Rifai Moulavi Al Haj A. C. A, Faleel (Cassimi) will deliver the speech on the significance of this occasion.


Police security for B'cola mayor

Batticaloa - Mayor of Batticaloa, Chelliyan E. Perinbana-yagam has been given police security following an appeal he made to the President. Mr. Perinbanayagam is an independent member supporting TELO.

Two police officers from the Batticaloa police and two from Colombo have now been assigned for the job Mr. Perinbanyagam had his own security earlier.


Srimani condoles over Mahanayake Thera's death

United Lalith Front leader Srimani Athulathmudali said in a condolence message, the services rendered to the sasana by the most Ven. Piyadassi Thera have been appreciated greatly both in Sri Lanka and abroad and many honours have been bestowed on him especially by other Buddhist countries.

The full text of the condolence message is as follows:

It was with profound sorrow that we received the news of the passing away of the Most Ven. Piyadassi Maha Thera. A pupil of the late Ven. Pelene Sri Vajiragnana Maha Nayake Thera, Ven. Piyadassi Maha Thera was an erudite scholar most learned in the Dhamma and was also an eminent linguist.

The late Maha Thera led a simple life devoting most of his time and energy to the spreading of the Dhamma and producing scholarly works on the Dhamma. Ven. Piyadassi Thera had spent time in a large number of countries engaged in Dharmaduta work and had been the first Buddhist monk to visit many countries in Europe and the Americas.

He remained a leading light in the teaching of Dhamma for a long period and was responsible for the opening of a Dhamma school at the Sambodhi Viharaya to teach Dhamma in English. His passing away is a great loss to the all Buddhists throughout the world.

May he attain supreme bliss of 'Nibbana'.


Court of Appeal in ceremonial sitting

The Court of Appeal, on August 24, will hold a ceremonial sitting to welcome, the recently appointed President of the CA Justice A. Ismail.


Mayor's rights application Leave to proceed granted

The Supreme Court on Friday granted leave to proceed with the Fundamental Rights violation application of Major Nambukaragamage Chandrasena of the Sri Lanka Army and directed the Commander of the Sri Lanka Army and the Director Supplies and Transport of the Sri Lanka Army, to grant the petitioner a vehicle to travel for medical treatment, until the final determination of his case.

The petition said that the action of the Army Commander Lt. General R. D. S. Daluwatte and the Director Supplies and Transport, Brigadier P. G. Charles in withdrawing the vehicle given to the petitioner which he was authorized to hold till December 1998, is arbitrary, capricious, mala fide unlawful and unreasonable, and is in violation of the petitioner's Fundamental Rights and has also urged the petitioner be treated equally before the law, as enshrined in Article 12 (1) of the Constitution of Sri Lanka.

The petition also said that the action on the part of the Commander of the Army and the Direcor Pay and Records, Brigadier C. S. D. Gunasinghe, to stop the petitioner's salary and allowances, since October 1997, to-date is arbitrary and unreasonable, and is violative of Article 12 (1) of the Constitution.

The petitioner believes that the actions of the first respondent, Lt. General Daluwatte, has been motivated due to animosity.

The petitioner has moved the Supreme Court to grant leave to proceed, declare the violation of Fundamental Rights, and further to grant interim relief until the final determination of this application.

On Friday, the petition was supported before the Supreme Court by Anuja Premaratne with Viraj Amerasinghe and Saman de Silva, instructed by Sandun Gamage.

The bench comprised, the Chief Justice G. P. S de Silva, Justice A. S. Wijetunga and Justice Dr. Shirani Bandaranayake.

The case is to be mentioned on August 28.
